1. This website is maintained by MyOnlineCaddie.com, hereby referred to as 'we' or 'us'. In using this site you agree to the terms and conditions listed below. While reasonable steps have been taken to ensure that the information contained is updated and accurate. We make no warranties about the accuracy of the information, assume no responsibility for inaccuracies or mistakes in the information, and reserve the right to make changes to the products and services described in this site any time without notice.
2.You must take the time to read and understand the Terms and Conditions before registering for the myonlinecaddie.com service. By registering, you accept that you are entering into a contract with us on the terms of this Agreement.
3.We want you to browse this site freely, but you do so at your own risk. That is, we are not responsible or liable for damages of any kind (including but not limited, to direct, indirect, incidental, consequential or punitive) related to your use of this site.
4.To the fullest extent permitted at law we provide this website and its contents on an 'as is' basis and makes no (and expressly disclaims all) representations or warranties of any kind. Express or implied, with respect to this website or the information, content, materials or products included on this site including without limitation, warranties or merchantability and fitness for a particular purpose. In addition, we do not represent or warrant that information accessible via this website is accurate, complete or current. Neither we nor any of our affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this website or the information, content, material or products included on this site.
5.We may provide electronic links to third party websites (including contract affiliates), which are not owned, or operated as part of this website. We shall in no way be responsible for the content or any representations made on websites by such third parties and have not reviewed the content of such sites. 8.We welcome your feedback at various places in this site. However, any communication or other material you send to this site by e-mail or other means, including your questions or comments will not be treated as confidential. We, or our affiliates may use any communication or other material you transmit to the site (and the ideas contained in the material) for any purpose, including reproducing, posting or publicising such material or using the material for marketing purposes.
9.On occasions Myonlinecaddie offer a free trial where you are able to enter up to three scorecards, the free trial also includes entrance to all the other services, except the online quiz and the online lessons. Once three scorecards have been entered you will be prohibited from using the site until the full yearly membership fee has been paid. MyOnlineCaddie reserve the right to cancel a free trial at any time.
10.If you decide to confirm you are agreeing to take membership we make available to you shortly after your fee is paid. Membership will last for twelve months.
11.Members wishing to use the cheque/postal order method of payment are required to post the payment to the myonlinecaddie address (which can be found on the website at www.myonlinecaddie.com) within 14 days of activating their account. If no payment is received within the 14 days time period then we reserve the right to deactivate the account without prior notice.
12.Your membership details, including your e-mail address, will never be passed to any other company or individuals.
13.You must ensure that the e-mail address we hold for you is kept up-to-date. If you change e-mail address then you must inform us of the new address through the 'contact us' method.
14.If the membership fee was received through the online credit/debit card system we will notify members 14 days before the renewal date of their membership (if the membership fee is going to increase then 28 days notice will be given). Each notification will include the date when the renewal is to take place. This fee will apply for the next twelve months. If you do not wish to proceed with automatic renewal of your membership it is your responsibility to inform us of this decision by using the 'contact us' method. If no notication is received within the 14 days notice period then renewal of your membership will automatically take place.
15. If the membership fee was received through the cheque/postal order system we will notify members 14 days before the renewal date of their membership (if the membership fee is going to increase then 28 days notice will be given). Each notification will include the date when the renewal is to take place. This fee will apply for the next twelve months. If no payment is received by either payment method within the 14 days notice period then the membership will be cancelled without prior notice.
16. Please note that we reserve the right to change the amount of the fee for membership and the period which it covers at any time.
17. We will from time to time have special offers with regard to the fee for membership. The time specified for any secial offers will be honoured and the decision to exend any offers will be MyOnlineCaddie's decison only. Members who have previosly joint MyOnlineCaddie and paid any other amount of fee will not be liable for a refund.
18.You undertake to register for the MyOnlineCaddie service using accurate and current information about yourself - including your correct name, address and any other requested details. You also undertake only to add yourself. If you are asked for, and provide, details of a credit, debit, or charge card, you must insure that (a) you are fully entitled to use that card and (b) it has available funds sufficient to cover the charges which are deducted from it. As part of the registration process for the myonlinecaddie service you will receive a verification e-mail, the purpose of which to take reasonable steps to ensure that the e-mail address you have nominated during registration is controlled by you. That e-mail contains simple instructions which you must follow.
19.We or our affiliates may offer new or additional services through the MyOnlineCaddie.com service from time to time. Your use of those services may be subject to additional Terms and conditions, or rules of use, which you must comply with. Any failure by you to comply with a material provision of the terms or rules governing such additional services will amount to a breach of this agreement and enable us to terminate this Agreement with you. There may also be times when the myonlinecaddie.com service becomes inaccessible as a result of technical difficulties experienced by myonlinecaddie.com or on the internet; we will, however, use reasonable skill and care to overcome these difficulties where they are within our control.
20.We reserve the right (a) to suspend or terminate any member's access to the MyOnlineCaddie service and (b) to remove, or require the member to remove, material posted on the myonlinecaddie service, if the relevant member or material appears to us, or to a complaint, to be in breach of any provision to this Agreement. Any person whose access has been terminated must not re-register for, or re-assess the MyOnlineCaddie services without our prior consent. You are responsible for everything which is done on or through the myonlinecaddie service while your membership account is logged onto the MyOnlineCaddie service, or through your e-mail address(ess). In addition we reserve the right to terminate any member's access to the MyOnlineCaddie service, if the relevant member is abusive, discriminatory or threatening, or be seen to use any of the site facilities fraudulently. Members must not place any material on myonlinecaddie.com for any business or commercial services.
21. If you decide to become a member, and therefore pay our full membership fee, you are agreeing to take the full twelve month membership we make available to you promply after that fee is paid. This means that you do not have the right to cancel your membership during the cooling-off period which is provided for certain purchases under the consumer protection (Distance Selling) Regulations.
22.You are responsible for ensuring that no material you post in the photo gallery will appear to be offensive, threatening, abusive, discriminatory, obscene, pornographic, false, libellous, defamatory, unreliable or misleading. Should such products be sent to MyOnlineCaddie we reserve the right to withdraw the material and terminate the membership.
23.Each member acknowledges that we are entitled to withdraw any material on the MyOnlineCaddie services which appear indemnity. You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through a machine on which you access the MyOnlineCaddie services.
24.Members who consistently input wrong information, data, facts or figures into the 'score' card system will automatically have their agreement with myonlinecaddie terminated and can not re-apply without the prior consent of MyOnlineCaddie.
25. We will answer any queries through the 'contact us' section within two working days (this does not include Saturday, Sunday or Bank Holidays)
26.The MyOnlineCaddie quiz will be free to myonlinecaddie members. The quiz will be monthly although we reserve the right to change this time period. The quiz will run from the fifth day of each month until the last day of each month. The winner of each quiz will be the member who attains the highest score. The leader board will run the duration of the quiz showing the current leader and runners up (up to nine). There is a time limit of six minutes on the quiz and any member exceeding this time will not be shown on the leader board. Each member will be allowed one attempt at the quiz each month. In the event of multiple winners the outright winner will be picked randomly. Myonlinecaddie's decision is final and no correspondence or review can be entered into by MyOnlineCaddie. The prize will be determined by us and will not be advertised. Should a member be found to be using the quiz fraudulently then we reserve the right to insantly disqualify that member from the quiz in session and terminate their membership. At the end of the quiz we will check the ten members on the leader board for multiple entries, and we reserve the right to detemine if these multiple memberships have been used to enter the quiz dishonestly. The prize will be posted to the winner and MyOnlineCaddie can not be held responsible for any failure of delivery or damage caused by any postal company used by us. Please allow twenty eight days for delivery of the prize. Prizes can only be sent to members that have fully paid their annual membership. If a winner has paid by cheque/postal order and payment has not been received by us or cleared by the 2nd day of the following month then the prize will be sent to the next fully paid member on the leader board.
27. By listing a golf buddie to 'my golf buddies' this will automatically generate an email inviting that person to become a member of MyOnlineCaddie.
28.Once a 'golf buddie' completes the profile details and ticks the 'public' box where indicated on the profile page their details including, skill level, location, club/society, confirming whether or not they are a myonlinecaddie member, home telephone number, mobile telephone number, date of birth will appear on the member's 'my golf buddie' profile. The birthday will also appear on the member's calendar including their age.
29. This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
30. We reserve the right to have promotional free memberhship periods and no fee paying member will be entitled to a refund in part or full.
31. Should membership ever become free on a permanent basis then no fee paying member will be entitled to a refund in part or full.
32. Only one free membership per person is allowed and we have the right to deactivate any duplicate membership. Should a member continuously join more than once we reserve the right to terminate their membership.
33. Advertise your golf club/lessons. Any payment advertised is for a full calendar year. We reserve the right to change the fee for advertising and the time it covers in this section. If payment has not been received within14 days from payment request we reserve the right to remove the advertisement from the website.
34. Handicap Certificates. No handicap certificate will be issued to a member unless payment has been received. We reserve the right to refuse to issue a handicap certificate to a member who has gained a handicap fraudulently. The MyOnlineCaddie handicap certificate is not an official certificate. Please allow 7 working days for delivery and we can not be held responsible for any failure of delivery or damage caused by any postal company used by us.
35. Any promotions for free advertising for golf clubs on the MyOnlineCaddie website will be for one full year. In return the golf club will distribute the MyOnlinecaddie full colour flyers and will display the MyOnlineCaddie banner on the golf club's official website. If the MyOnlineCaddie banner is not being displayed on the golf club's website within 7 days of the agreed date then MyOnlineCaddie reserve the right to cancel and remove the golf club from the MyOnlineCaddie website. MyOnlineCaddie also reserves the right to check that their banner is showing on the golf club's website for the full year. If the banner is removed from the golf club's website for any reason then MyOnlineCaddie reserves the right to cancel and remove the golf club from the MyOnlineCaddie website.
36. These terms and conditions are applicable now and were last updated on the 3rd October 2007. We reserve the right to modify these terms and conditions from time to time without notifying our visitors. Visitors agree to periodically view our terms and conditions which will always be available on the www.myonlinecaddie.com website.
